5. Ordering, Payment, and Pricing

5.1 Order Placement

When you place an order through our Site, you are making an offer to purchase the selected items subject to these Terms. We reserve the right to accept or reject any order at our sole discretion. A confirmation email or on-screen message does not constitute acceptance of your order until the order has been processed and confirmed by us.

All orders are subject to availability. In the event that an item is unavailable after your order is placed, we will notify you and provide you with the option to substitute the item or receive a refund for that item.

5.2 Pricing

All prices displayed on the Site are in United States Dollars (USD) and are subject to applicable sales taxes as required by state and local laws. Due to the perishable nature of food products, all sales are generally final once an order has been prepared. Order cancellations may only be made before food preparation has begun. Once preparation has started, cancellations may not be accepted, and charges may still apply.

Delivery services are available within designated delivery zones. Delivery times provided are estimates only and are not guaranteed. Green Lantern Pizza shall not be liable for delays due to traffic, weather conditions, high order volume, or other circumstances beyond our control.

Delivery fees, minimum order requirements, and tipping options (where available) will be displayed at checkout. You are responsible for ensuring that the delivery address is accurate and accessible. If delivery cannot be completed due to an incorrect address or unavailability of the recipient, additional charges may apply.

7. Intellectual Property Rights

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, IN NO EVENT SHALL GREEN LANTERN PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your access to or use of, or inability to access or use, the Site or our services;
• Any conduct or content of any third party on the Site;
• Any food products purchased through the Site;
• Unauthorized access, use, or alteration of your transmissions or content;
• Any errors or omissions in any content on the Site;
• Delivery delays, cancellations, or failures.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO GREEN LANTERN PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

These limitations apply regardless of the legal theory upon which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise, and even if Green Lantern Pizza has been advised of the possibility of such damages. Some states do not allow limitations on implied warranties or the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Green Lantern Pizza, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

14. Dispute Resolution

14.1 Informal Resolution

We will make a good-faith effort to resolve any dispute within thirty (30) days of receiving your written notice. If the dispute is not resolved within that period, either party may pursue formal dispute resolution as described below.

14.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except for claims for injunctive or equitable relief, or claims relating to intellectual property rights, any dispute, controversy, or claim arising out of or relating to these Terms, the Site, or our services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding.

You and Green Lantern Pizza each agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. YOU HEREBY WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. If this class action waiver is found unenforceable in any way, the entire arbitration agreement shall be null and void.

14.3 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction, provided that the action remains in small claims court and is not removed or appealed to a court of general jurisdiction.

15. Term and Termination

These Terms shall remain in full force and effect for as long as you access or use the Site. Green Lantern Pizza reserves the right, in its sole discretion and without prior notice or liability, to:

• Terminate or suspend your access to all or part of the Site for any reason, including but not limited to a violation of these Terms;

The invalidity, illegality, or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions of these Terms, which shall remain in full force and effect.
